Terms & Conditions

Welcome to GCS Tree & Landscaping. These Terms and Conditions govern your use of our services, including but not limited to Landscaping, Tree Care & Removal, and Hardscaping. By requesting or accepting our services, you agree to be bound by these terms.

 

1. Service Agreement & Estimates

 

  1. Scope of Work: The specific services to be provided (the "Scope of Work") will be detailed in a written estimate or proposal provided to the client. Only the work explicitly listed in the accepted proposal will be performed.

  2. Estimates: All estimates are valid for 30 days from the date of issuance. Estimates are based on the existing conditions and accessible information at the time of assessment.

  3. Changes: Any additions or modifications to the Scope of Work must be agreed upon in writing by both GCS Tree & Landscaping and the client. Additional work may result in a revised price and timeline.

  4. Client Responsibility (Site Conditions): The client is responsible for identifying and clearing any buried obstacles, pipes, wires, or irrigation lines (not installed by GCS) in the work area. The client must also ensure the work area is clear of pets, hazardous materials, and any items that could impede service prior to the scheduled start date.

 

2. Pricing and Payment

 

  1. Pricing: The final price for services is as stated in the accepted proposal or revised written agreement.

  2. Payment Terms:

    • Landscaping & Tree Care: For services under a specified amount (e.g., $1,000), payment in full is due upon completion of the work.

    • Large Projects (Hardscaping/Extensive Landscaping): For projects over a specified amount, a deposit (e.g., 50% of the total cost) is required upon signing the agreement, with the balance due upon satisfactory completion of the work.

  3. Invoices: Invoices are typically issued upon completion and are due within [e.g., 7 days or 30 days] of the invoice date.

  4. Late Payment: GCS Tree & Landscaping reserves the right to charge a late fee of [e.g., 1.5%] per month on any outstanding balance not paid within the specified terms.

  5. Cancellation: If the client cancels a confirmed and scheduled service or project, GCS Tree & Landscaping reserves the right to retain the deposit or charge a cancellation fee to cover preparatory costs, mobilization fees, and lost scheduling time.

 

3. Service-Specific Terms

Tree Care & Removal

 

  1. Stump Grinding: Unless specifically included in the Scope of Work, stump grinding is not part of a standard tree removal service. Debris from stump grinding (wood chips) will be left in the hole unless hauling is specifically requested and priced.

  2. Utilities: GCS will call 811 for utility locates for any digging or deep-grinding work. However, the client acknowledges that utility marking is not always precise, and GCS is not liable for damage to unmarked or incorrectly marked underground lines not installed by our team.

 

Landscaping & Planting

 

  1. Plant Material Warranty: GCS Tree & Landscaping provides a limited warranty on plant material for a period of [e.g., 90 days] from the date of installation, provided the client has followed all watering and care instructions provided by GCS. This warranty is void if plant material failure is due to neglect, improper watering, pest infestation not caused by GCS, or extreme weather conditions (e.g., drought, freeze). Annual flowers are generally not covered by a warranty.

  2. Irrigation: GCS is not responsible for existing irrigation systems. We will exercise reasonable care but are not liable for damage to unmarked or improperly installed irrigation components.

 

Hardscaping

 

  1. Materials: All materials used will be of standard industry quality. Minor variations in color, texture, and size of natural materials (e.g., stone, pavers) are inherent and are not considered defects.

  2. Minor Settling: The client acknowledges that minor settling of hardscape features (e.g., patios, walkways) may occur over time due to natural soil movement and is not considered a defect in workmanship.

 

4. General Provisions

 

  1. Limitation of Liability: GCS Tree & Landscaping is not responsible for damage to the client's property that is a direct and necessary result of performing the agreed-upon services (e.g., tire marks on a lawn due to equipment, sawdust, or minor unavoidable soil disruption). We take all reasonable precautions to minimize disruption and damage.

  2. Insurance: GCS Tree & Landscaping maintains comprehensive General Liability and Workers' Compensation insurance. Proof of insurance is available upon request.

  3. Photography: The client grants GCS Tree & Landscaping the right to photograph the property before, during, and after service completion for the purpose of business promotion, portfolio, and marketing (e.g., website, social media).

  4. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the State of Michigan
